What is a professional or commercial lease?
A professional or commercial lease is the granting of the use of a property by the owner to a tenant in order for the latter to carry out a professional or commercial activity.
Indicative examples of commercial leases:
- Retail or wholesale shop, health care establishment
- Hotel or tourist accommodation (licensed)
- Medical, dental, law or accounting office
- Technical or architectural office
- Private school or nursery school
- Clinic or nursing home
Legal Framework: What Applies to Commercial Leases after 2014
With the Law 4242/2014 (Article 13), the regime in force until then (P.D. 34/1995) was amended. Now, professional leases are divided into:
- Leases concluded before 28/02/2014
- Leases concluded after 28/02/2014
In all cases, the general provisions of the Civil Code.
Key Points of the New Commercial Leases:
Duration of the Lease:
It is freely determined by the parties. If not specified, it shall apply mandatory three-year duration.
Amount of Rent:
It shall be freely determined by the Parties and paid compulsory interbanking.
Rent Adjustment (2025):
Based on the Ν. 5079/2023 (Article 57(5)), provides for 3% ceiling for small and medium-sized properties (there are exceptions).
Stamp duty/Digital transaction fee:
3,6% on the agreed rent.
Termination or Cancellation of the Lease:
It is done in writing and the lease is terminated three (3) months from the notification of the complaint.
What has been repealed
Law 4242/2014 Cancel several old provisions of the Decree 34/1995, such as:
- Complaint for appropriation or reconstruction
- Complaint for demolition of a crumbling building
- Compensation for intangible commercial value
