{"id":2391,"date":"2025-03-24T10:41:44","date_gmt":"2025-03-24T07:41:44","guid":{"rendered":"https:\/\/sintorislaw.gr\/?p=2391"},"modified":"2025-03-24T10:41:46","modified_gmt":"2025-03-24T07:41:46","slug":"berufliche-und-gewerbliche-mietvertrage","status":"publish","type":"post","link":"https:\/\/sintorislaw.gr\/de\/berufliche-und-gewerbliche-mietvertrage\/","title":{"rendered":"Berufliche und gewerbliche Mietvertr\u00e4ge: Was Sie wissen m\u00fcssen"},"content":{"rendered":"<p><strong>Was ist ein professioneller oder gewerblicher Mietvertrag?<\/strong><\/p>\n\n\n\n<p>Ein beruflicher oder gewerblicher Mietvertrag ist die \u00dcberlassung einer Immobilie durch den Eigent\u00fcmer an einen Mieter, damit dieser eine berufliche oder gewerbliche T\u00e4tigkeit aus\u00fcben kann.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-\u03b5\u03bd\u03b4\u03b5\u03b9\u03ba\u03c4\u03b9\u03ba\u03ac-\u03c0\u03b1\u03c1\u03b1\u03b4\u03b5\u03af\u03b3\u03bc\u03b1\u03c4\u03b1-\u03b5\u03c0\u03b1\u03b3\u03b3\u03b5\u03bb\u03bc\u03b1\u03c4\u03b9\u03ba\u03ce\u03bd-\u03bc\u03b9\u03c3\u03b8\u03ce\u03c3\u03b5\u03c9\u03bd\">Beispiele f\u00fcr gewerbliche Mietvertr\u00e4ge:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Einzel- oder Gro\u00dfhandelsgesch\u00e4ft, Einrichtung des Gesundheitswesens<\/li>\n\n\n\n<li>Hotel oder Touristenunterkunft (mit Lizenz)<\/li>\n\n\n\n<li>Arzt-, Zahnarzt-, Anwalts- oder Buchhaltungsb\u00fcro<\/li>\n\n\n\n<li>Technisches oder architektonisches B\u00fcro<\/li>\n\n\n\n<li>Privatschule oder Kindergarten<\/li>\n\n\n\n<li>Klinik oder Pflegeheim<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Rechtlicher Rahmen: Was f\u00fcr gewerbliche Mietvertr\u00e4ge nach 2014 gilt<\/h2>\n\n\n\n<p>Mit dem&nbsp;<strong>Gesetz 4242\/2014<\/strong>&nbsp;(Artikel 13) wurde die bis dahin geltende Regelung (P.D. 34\/1995) ge\u00e4ndert, so dass nun die Berufspacht in folgende Bereiche unterteilt wird:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Abgeschlossene Mietvertr\u00e4ge\u00a0<strong>vor 28\/02\/2014<\/strong><\/li>\n\n\n\n<li>Abgeschlossene Mietvertr\u00e4ge\u00a0<strong>nach 28\/02\/2014<\/strong><\/li>\n<\/ul>\n\n\n\n<p>In allen F\u00e4llen gelten die allgemeinen Bestimmungen der&nbsp;<strong>B\u00fcrgerliches Gesetzbuch<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Die wichtigsten Punkte der neuen gewerblichen Mietvertr\u00e4ge:<\/h3>\n\n\n\n<p><strong>Dauer des Mietvertrags:<\/strong><br>Sie wird von den Parteien frei festgelegt. Wenn nicht angegeben, gilt sie\u00a0<strong>obligatorische dreij\u00e4hrige Laufzeit<\/strong>.<\/p>\n\n\n\n<p><strong>H\u00f6he der Miete:<\/strong><br>Sie wird von den Vertragsparteien frei festgelegt und gezahlt\u00a0<strong>Interbankenzwang<\/strong>.<\/p>\n\n\n\n<p><strong>Mietanpassung (2025):<\/strong><br>Auf der Grundlage der\u00a0<strong>\u039d. 5079\/2023<\/strong>\u00a0(Artikel 57 Absatz 5), sieht vor\u00a0<strong>3% Decke<\/strong>\u00a0f\u00fcr kleine und mittlere Grundst\u00fccke (es gibt Ausnahmen).<\/p>\n\n\n\n<p><strong>Stempelsteuer\/Digitalisierungsgeb\u00fchr:<\/strong><br>3,6% auf die vereinbarte Miete.<\/p>\n\n\n\n<p><strong>Beendigung oder Aufhebung des Mietvertrags:<\/strong><br>Die K\u00fcndigung erfolgt schriftlich und der Mietvertrag wird beendet.\u00a0<strong>drei (3) Monate<\/strong>\u00a0ab dem Zeitpunkt der Zustellung der Beschwerde.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Was wurde aufgehoben?<\/h2>\n\n\n\n<p>Gesetz 4242\/2014&nbsp;<strong>Abbrechen<\/strong>&nbsp;mehrere alte Bestimmungen des Dekrets 34\/1995, wie z.
