{"id":140,"date":"2023-05-10T20:43:10","date_gmt":"2023-05-10T17:43:10","guid":{"rendered":"http:\/\/xtratheme.comlawyers\/?p=140"},"modified":"2023-05-29T20:51:59","modified_gmt":"2023-05-29T17:51:59","slug":"prostimoseparoxiogiagdpr","status":"publish","type":"post","link":"https:\/\/sintorislaw.gr\/de\/prostimoseparoxiogiagdpr\/","title":{"rendered":"Geldstrafe gegen einen Telekommunikationsanbieter durch die DPAA"},"content":{"rendered":"<p>Entscheidung 7:<\/p>\n<p>Die \u00dcberwachungsbeh\u00f6rde pr\u00fcfte die Beschwerde einer Vodafone-Teilnehmerin, die nach einem Antrag auf Zugang zu ihren aufgezeichneten Gespr\u00e4chen mit dem Callcenter von Vodafone \u00fcber ein Verarbeitungsunternehmen eine CD mit Gespr\u00e4chen eines anderen Teilnehmers erhalten hatte. Obwohl Vodafone sofort von der Beschwerdef\u00fchrerin benachrichtigt wurde, ergriff es keine Ermittlungsma\u00dfnahmen, um den Vorfall zu best\u00e4tigen oder zu dementieren, sondern begn\u00fcgte sich zun\u00e4chst mit der Antwort des Verarbeitungsunternehmens, dass es die Beschwerdef\u00fchrerin nicht zum Telefon zur\u00fcckverfolgt hatte, und forderte sie dann schriftlich \u00fcber den Verbraucherschutzbeauftragten auf, die CD zur\u00fcckzugeben, wodurch die Verantwortung f\u00fcr die Untersuchung des m\u00f6glichen Vorfalls auf das Subjekt \u00fcbertragen wurde.<\/p>\n<p>Vodafone wurde angewiesen, dem Recht durch \u00dcbersendung der korrekten Datei nachzukommen, und mit einem Bu\u00dfgeld von 40 000 EUR belegt, weil es gegen das Auskunftsrecht des Beschwerdef\u00fchrers gem\u00e4\u00df Artikel 15 der Datenschutz-Grundverordnung und die Verpflichtung zur Offenlegung des Vorfalls gem\u00e4\u00df Artikel 33 der Datenschutz-Grundverordnung versto\u00dfen hatte.<\/p>\n<p>Entscheidung 5:<\/p>\n<p>Die Beh\u00f6rde untersuchte die Beschwerde eines Teilnehmers, der auf seinen Antrag auf einen neuen Vodafone-Anschluss hin ein Paket mit Mustern von Konsumg\u00fctern von einem mit Vodafone zusammenarbeitenden Werbeunternehmen erhielt, obwohl er der Verwendung seiner Daten zu Marketingzwecken widersprochen hatte. Nach Ansicht von Vodafone handelte es sich bei der Zusendung des Pakets nicht um eine Werbema\u00dfnahme, sondern um eine Nebenbestimmung des zwischen den Parteien bereits geschlossenen Telekommunikationsdienstleistungsvertrags, der ausnahmslos allen neuen Abonnenten, die sich \u00fcber die Website www.vodafonecu.gr anmelden, unabh\u00e4ngig von ihrer Wahl in Bezug auf Werbema\u00dfnahmen zugesandt wird, und \u00fcber den mittels eines auf dieser Website angebrachten Banners informiert wird.<\/p>\n<p>Die Beh\u00f6rde vertrat die Auffassung, dass die \u00dcbermittlung an ein Werbeunternehmen und die damit verbundene Verarbeitung der Daten des Beschwerdef\u00fchrers zu Werbezwecken erfolgte und damit gegen den Grundsatz der Rechtm\u00e4\u00dfigkeit, Objektivit\u00e4t und Transparenz der Verarbeitung verstie\u00df, da sie weder f\u00fcr den Vertragszweck erforderlich war noch von der betroffenen Person, die der Verwendung und \u00dcbermittlung ihrer Daten zu Werbezwecken ausdr\u00fccklich widersprochen hatte, vern\u00fcnftigerweise erwartet werden konnte, w\u00e4hrend nicht nachgewiesen wurde, dass der Beschwerdef\u00fchrer gem\u00e4\u00df Artikel 13 DSGVO umfassend \u00fcber die betreffende Verarbeitung informiert worden war.
